The work of Community Services and community partners in providing out-of-home care services is governed by the Children and Young Persons (Care and Protection) Act 1998.

What is the aim of this legislation?

The out-of-home care provisions of the Children and Young Persons (Care and Protection) Act 1998 aim to:

  • create a high standard in the provision of out-of-home care
  • provide a model for the organisation of out-of-home care
  • clarify the roles and responsibilities of those involved in the provision of out-of-home care.

Overall, these sections of the legislation lay the foundation for significant improvements in the care of the State’s most vulnerable children and young people – those who can't live at home.
