The Children and Young Persons (Care and Protection) Act 1998

The provision of children’s services in NSW is governed by Chapter 12 of The Children and Young Persons (Care and Protection) Act 1998 which deals with a number of matters relating to the provision of children’s services in NSW, including:

  • the meaning of ‘children’s services’
  • principles underlying the provision of children’s services
  • licensing of children’s services
  • matters relating to parents
  • exclusion of people from children’s service’s premises
  • termination of illegal children’s services
  • the Regulation

Children’s services Regulation 2004

The Children’s Services Regulation 2004 which specifies what needs to be done to establish and operate a children’s service, and how these requirements are to be done, including:

  • licence applications
  • granting licences
  • conditions of licences for different types of children’s services
  • the number of children who may be provided with a children’s service
  • facilities and equipment
  • administration of a children’s service
  • practices for providing a children’s service
  • probity checks of children’s services providers
  • appeals against decisions made involving children’s services licences
